Terms and Conditions – U.S. Based Customers

1. Introduction

Welcome to DumpsterPro, a software product owned and operated by Smart Business Consulting LLC (“Company,” “we,” “our,” or “us”).
These Terms and Conditions (“Terms”) govern your access to and use of DumpsterPro’s software platform, applications, and related subscription services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms.

2. Definitions

  • DumpsterPro: The software platform and services offered under the DumpsterPro brand.

  • Company: Smart Business Consulting LLC.

  • Service: All software, tools, features, and services provided through DumpsterPro.

  • User: Any individual or business entity using the Service.

  • Subscription: A paid recurring plan granting access to the Service.

3. User Accounts

Certain features of the Service require account registration. You agree to:

  • Provide accurate and current information;

  • Maintain the confidentiality of your login credentials; and

  • Accept responsibility for all activity conducted through your account.

Smart Business Consulting LLC is not responsible for losses resulting from unauthorized account access due to your failure to safeguard credentials.

4. Subscription Terms

Plans: DumpsterPro offers subscription plans billed on a recurring monthly basis. Plan details and pricing are published on our website.

Billing: Subscriptions are billed monthly, typically on the anniversary date of account activation. Accepted payment methods may include major credit cards.

Auto-Renewal: Subscriptions automatically renew unless canceled prior to the next billing date.

Changes: Requests to modify or cancel a subscription must be submitted in writing to the Company.

5. Free Trials and Promotions

From time to time, DumpsterPro may offer free trials or promotional access. Smart Business Consulting LLC reserves the right to modify, suspend, or terminate any trial or promotion at its sole discretion.

6. Cancellation and Refund Policy

Cancellation:
Users may cancel their subscription by submitting a written request that includes:

  • Business owner name

  • Company name

  • Company address

  • Phone number

Cancellations become effective at the end of the current billing cycle.

Refunds:
No refunds are issued for partial billing periods, unused time, or unused features.

7. User Responsibilities and Acceptable Use

Users agree not to:

  • Violate any applicable federal, state, or local laws;

  • Infringe intellectual property rights;

  • Introduce malicious software or harmful content.

Competing Platforms:
Any User found to be actively using or subscribed to a competing dumpster management, routing, dispatch, or operational platform while maintaining an active DumpsterPro subscription may have their subscription terminated immediately.
Smart Business Consulting LLC retains sole discretion in determining what constitutes a competing platform.

8. Intellectual Property

All software, content, trademarks, branding, and data associated with DumpsterPro are the exclusive property of Smart Business Consulting LLC or its licensors.

Users are granted a limited, non-exclusive, non-transferable, and revocable license to use the Service solely for its intended business purpose.

9. Limitation of Liability

To the fullest extent permitted by law, Smart Business Consulting LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to the use of or inability to use DumpsterPro.

10. Indemnification

You agree to indemnify, defend, and hold harmless Smart Business Consulting LLC, its owners, affiliates, officers, employees, agents, and service providers from all claims, damages, losses, liabilities, penalties, fines, and expenses (including reasonable attorneys’ fees) arising from:

(a) your use or misuse of the Service;
(b) your violation of these Terms or applicable laws;
(c) your infringement of third-party rights; and
(d) any fees, surcharges, service fees, or charges imposed by you on your customers through or in connection with the Service.

For clarity, Smart Business Consulting LLC does not set, approve, control, or audit fees imposed by Users and bears no responsibility for such charges.

11. Termination

Smart Business Consulting LLC reserves the right to suspend or terminate access to DumpsterPro at any time for violations of these Terms or conduct deemed harmful to the Service or other users.

12. Governing Law and Venue

These Terms shall be governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles.
All disputes shall be resolved exclusively in state or federal courts located in Delaware.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

Sections remain substantively identical, with all references to ownership, indemnification, intellectual property, SMS consent, and CASL compliance applying to Smart Business Consulting LLC as the operating entity behind DumpsterPro.
